The topic of the presence of German services on Polish territory has sparked controversy and numerous questions. The matter gained prominence after Aleksandra Fedorska -- a commentator for Tysol.pl and editor-in-chief of Radio Debata, among other outlets -- directed an inquiry to the German police commissariat in Ludwigsdorf. It concerned the presence of a German patrol car patrolling the vicinity of the Polish side of the bridge in Zgorzelec.
In response, the German services cited an agreement between the governments of Poland and Germany from May 2014 concerning cooperation between police, border guard, and customs services. According to information provided by the German authorities, the rules of this cooperation were set out in the German Federal Law Gazette.
The response of the German police was commented on by legal expert Dr. Bartosz Lewandowski, who emphasized that the 2014 Polish-German agreement grants German services broad powers on Polish territory. Within the framework of joint patrols, they may, among other things:
Additionally, German services -- with the consent of the Polish side -- may conduct undercover operations and set up border control points on Polish territory.
In connection with the above, Aleksandra Fedorska announced on Wednesday that she had directed a request to the Polish Ministry of Interior and Administration for a list of requests from the last 10 weeks that might authorize German services to operate in Poland. Of key importance here is Article 5 of the 2014 agreement, which stipulates the need for written requests in such situations.
"Please provide all requests from the last 10 weeks that contain a written request to German authorities to operate on the territory of the Republic of Poland. Art. 5 of the Polish-German cooperation agreement from May 2014 defines such requests as a fundamental condition for operations on the territory of the other state. The German side regularly carries out official activities on Polish territory. I therefore ask you to present the requests from our Polish side that authorize German services to carry out such activities on the basis of the Polish-German agreement from May 2014,"
reads the message directed to the Polish Interior Ministry by Aleksandra Fedorska.
